Terms of purchase
What a spot on the vehicle means, what it does not, and how the process from order to tile is governed.
1. Scope and provider
These terms apply to all orders of a spot on the campaign vehicle of LUCERANTIS GROUP DOO placed through this website. The provider and contracting party is the company named in the imprint. Deviating terms of the buyer do not become part of the contract.
2. Subject
The subject of the contract is the application of a physical tile of approximately 8 x 8 mm carrying the image provided by the buyer to a position on the bodywork or in the interior of the campaign vehicle, together with the associated services (review, printing, application, confirmation). A spot creates no ownership, no co-ownership share, no right of use and no other claim in or to the vehicle. The vehicle remains the property of the provider or the respective keeper.
3. Process: photo before payment, review after payment
The buyer selects a spot, uploads a photo, crops it and sees a preview. Before paying, the buyer confirms these terms, the image rights and their minimum age. After receipt of payment, a member of the provider's staff reviews the photo for compliance with these terms, generally within 48 hours. Only after approval is the tile produced and applied. The buyer is informed of approval or rejection by email.
4. Rejection of a photo
If a photo is rejected, the buyer may upload one replacement photo free of charge. If the replacement is also rejected, or if the buyer does not upload a replacement within 14 days of the rejection notice, the contract is reversed and the amount paid is refunded in full via the original payment method. The spot is released again. There is no entitlement to have a rejected photo applied.
5. Prices, currencies and payment
Prices are set in euros and include statutory VAT where applicable. Display in other currencies is a conversion for orientation; the euro amount stated in the payment step is decisive. Depending on the payment provider and card issuer, conversion or foreign transaction fees may apply that are not charged by the provider. Payment is made via PayPal or via Stripe (card, Apple Pay, Google Pay, Klarna). The terms of the respective payment provider apply in addition.
6. Formation of contract
The presentation of spots on the website is not a binding offer but an invitation to order. By completing the payment process the buyer makes a binding offer. The contract is formed when the payment provider confirms receipt of payment; the buyer then receives a confirmation email with their spot number. A reservation before payment is time-limited and creates no entitlement to the spot.
7. Right of withdrawal for consumers
Consumers have a statutory right of withdrawal of 14 days from formation of the contract. Note for counsel: the tile is made to the buyer's individual specification. The provider intends to start production only after the withdrawal period has expired, or earlier if the buyer expressly requests that production begin before the period expires and acknowledges that the right of withdrawal is lost once production has begun. The precise arrangement (withdrawal instruction, model withdrawal form, moment of expiry, treatment of the review phase) is to be settled with counsel before launch. Until then: a withdrawal may be declared informally to the contact address in the imprint; payments already made are refunded within 14 days via the original payment method.
8. Production and tolerances
The digital preview is for orientation. Position, size, crop and colour rendering of the tile on the real vehicle may differ for technical reasons, in particular due to the curvature of the bodywork, the printing process, the film material and lighting conditions. The provider may shift a tile by a few positions or move it to an adjacent zone where this is necessary for technical or design reasons; the buyer will be informed. Minor deviations do not constitute a defect.
9. Duration, visibility and events
The provider will endeavour to keep the tiles on the vehicle for the duration of the campaign. No specific minimum duration, specific visibility, attendance at specific events, locations or media, or survival of the tile in the event of damage, accident, cleaning, repair, sale or decommissioning of the vehicle is warranted. Damaged tiles may be replaced at the provider's discretion. There is no claim to replacement, rectification or refund on grounds of duration or visibility as long as the provider conducts the campaign in good faith.
10. Image rights and warranties of the buyer
The buyer warrants that they hold, or are entitled to dispose of, all rights required in the uploaded image, that all persons shown have consented to the application to the vehicle and to the use provided for in the contract, in the case of minors the persons holding parental responsibility, and that the image does not infringe the rights of third parties. The buyer grants the provider the non-exclusive, worldwide right, for the duration of the campaign and its documentation, to apply the image to the vehicle and to depict, publish and promote the vehicle including the tiles. Use of the individual image detached from the vehicle, for example in the online gallery, takes place only with separate consent. The buyer indemnifies the provider against all third-party claims arising from a breach of these warranties, including reasonable costs of legal defence.
11. Prohibited content
Prohibited in particular are images that are unlawful, glorify violence, are pornographic, discriminatory, insulting or defamatory; that contain trademarks, logos, advertising messages, political or religious symbols or slogans; that show persons without their consent; that show minors without the consent of those holding parental responsibility; that contain text, QR codes or contact details; or that are otherwise unsuitable for a public campaign. The provider decides on suitability at its reasonable discretion.
12. Removal of tiles
The provider is entitled to remove or obscure a tile already applied if it subsequently transpires that the image breaches these terms, infringes third-party rights, a person shown withdraws their consent, or an official or court order so requires. Where removal is not due to a breach by the buyer, the provider refunds the amount paid. Where it is due to a breach by the buyer, the claim to the price remains; further claims of the provider remain unaffected.
13. Liability
The provider is liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health. In cases of slight negligence the provider is liable only for breach of essential contractual obligations, limited to the typical, foreseeable damage and at most to the price paid. Liability for lost profit, indirect damage or failure to achieve a particular public impact is excluded. Mandatory statutory liability, in particular under product liability law, remains unaffected.
14. No connection to the vehicle manufacturer
LUCERANTIS GROUP has no connection to Ferrari. The vehicle is the provider's campaign vehicle; Ferrari and SF90 Stradale are trademarks of their respective owners. Purchasing a spot creates no relationship of any kind with the manufacturer, and the buyer may not present their purchase as a connection to the manufacturer.
15. Governing law and venue
The law of the state in which the provider has its registered office applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected. The place of jurisdiction for merchants is the provider's registered office. The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr; the provider is not obliged to take part in dispute resolution proceedings before a consumer arbitration board and does not do so. Note for counsel: choice of law and venue are to be specified before launch according to the state of registration.
