Terms of purchase
What a place on the vehicle is, how an order works, and what rights you have.
1. Scope and provider
These terms apply to every order of a place on the campaign vehicle of Project 001 made through this website. The provider and your contracting party is LUCERANTIS GROUP DOO; the company details are listed in the imprint. Different terms of the buyer do not become part of the contract.
2. Subject of the contract
The subject of the contract is the production of a physical tile showing the buyer's live selfie and its application to a place in the area of the campaign vehicle chosen by the buyer, together with the related services (review, printing, application, confirmation). The exact place within the area is assigned by the provider; the buyer receives a personal place number. A place creates no ownership, co-ownership, right of use or any other right in the vehicle.
3. Order process
The buyer chooses an area, takes a selfie live with the camera, enters their details and then sees an order review with all details and the final price. Until the last click the buyer can correct every entry with "Back" or "Change details". By clicking the button "Confirm purchase and pay" the buyer places a binding order with an obligation to pay and is then taken to the payment provider. A place held before payment is reserved for a limited time only and gives no right to it.
4. Conclusion of the contract
The display of places on the website is not a binding offer but an invitation to order. The contract is concluded when the payment provider confirms the payment. The buyer then receives an email with the confirmation, the place number, these terms, the withdrawal form and the fiscal receipt.
5. Prices, currencies and payment
All prices are final prices including statutory VAT. Visitors from the Republic of Serbia see prices first in Serbian dinars (RSD); visitors from abroad can choose the currency in which prices are displayed (Art. 35 of the Law on Trade). The amount shown in the order review in the chosen currency is charged. The price of a place may rise as the number of available places on the vehicle decreases. Every increased price is shown clearly before the order is sent, and the price shown in the order review applies to that order. Payment is made through a licensed payment service provider in the Republic of Serbia, shown in the payment step; its conditions apply in addition. A fiscal receipt is issued for every purchase.
6. Review of the photo
After payment, a member of the provider's team checks whether the photo complies with these terms, usually within 48 hours; an automated pre-filter helps, but the decision is always made by a person. The tile is produced and applied only after approval. The buyer is informed of the approval or rejection by email.
7. Rejection of the photo
If the photo is rejected, the buyer can take one replacement selfie free of charge. If the replacement is also rejected, or if the buyer does not take one within 14 days of the rejection notice, the contract is reversed and the amount paid is refunded in full using the same payment method. The place becomes free again.
8. Performance period
The provider produces the tile and applies it to the vehicle within 20 days of the conclusion of the contract. If the photo is rejected, the period starts again when the replacement photo is approved.
9. Right of withdrawal
Consumers may withdraw from the contract within 14 days of its conclusion without giving reasons. A clear statement is enough – through the online form on the page "Withdrawal", by sending the withdrawal form that comes with the confirmation email, or via the contact form. Sending the statement before the deadline is sufficient. In the event of a withdrawal the provider refunds all payments received without delay, at the latest within 14 days of receiving the withdrawal, using the same payment method and without any fee. Early start: if the buyer, when placing the order, expressly requests that production of the tile begin before the withdrawal period ends (optional tick box in the order review, repeated in the confirmation email as a durable medium) and then withdraws, the buyer pays an amount proportionate to the service performed until the withdrawal, including the cost of the personalised tile already produced. If performance began at the buyer's express request and with the buyer's acknowledgement, the right of withdrawal ends once the service has been fully performed (Art. 36 of the Law on Consumer Protection).
10. Production and tolerances
The digital preview is for orientation. Position, size, crop and colours of the tile on the real vehicle may differ for technical reasons, in particular because of the curvature of the bodywork, the printing process, the foil material and the light. The provider may move a tile by a few positions within the chosen area where this is technically necessary. Slight deviations are not a defect.
11. Display period and visibility
The tile is displayed from its application until one month after the end of the public exhibition, at the latest 6 months after the end of the sales period. The sales period lasts 60 days from the first confirmed payment of the project. The provider informs buyers by email where and when the vehicle is exhibited. A particular visibility, presence at particular events, places or media, or the survival of a tile in the event of damage, cleaning or repair is not owed; damaged tiles are replaced where possible. After the display period the tiles are removed and the photos are deleted.
12. Rights in the photo and the buyer's warranties
(1) The buyer confirms that they took the photo live during the order and that it shows only the buyer. (2) Licence: as the author of the photo, the buyer grants the provider a non-exclusive, non-transferable licence, limited to Project 001 and the display period and with no fee beyond the price, to reproduce the photo by printing it on a tile, to display the vehicle with the tile publicly, and to show the vehicle in photos and videos documenting the project in which individual tiles are not the focus. Any other use, in particular showing the individual photo on the website, requires separate consent. (3) Likeness: the buyer expressly consents to the commercial use and public display of their likeness to this extent. This consent can be withdrawn at any time (privacy notice, section 4); this does not affect the lawfulness of the use before the withdrawal. (4) Warranties: the buyer warrants that they are the author of the photo and the person shown, that they hold all rights required for the licence, and that the photo does not infringe the rights of third parties. (5) Indemnity: if a third party asserts claims against the provider because one of these warranties is untrue, the buyer indemnifies the provider against these claims, including reasonable legal defence costs, unless the buyer is not responsible for the breach.
13. Prohibited content
Only the buyer's own face is permitted. Not permitted are in particular photos showing other persons or minors, brands, logos, text, QR codes, contact details, political or religious symbols, and any content that is unlawful, glorifies violence, is pornographic, discriminatory, offensive or defamatory, or otherwise unsuitable for a public campaign.
14. Removal of tiles
The provider removes a tile already applied without delay if the buyer withdraws their consent to the display of their likeness. The withdrawal of consent is free of charge and has no other negative consequences; whether the price is refunded is governed by the rules on withdrawal from the contract (section 9). The provider may also remove a tile if it later turns out that the photo breaches these terms or infringes the rights of third parties, or if an authority or court so orders. If the removal is not the buyer's fault, the provider refunds the price.
15. Liability
The provider is liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence the provider is liable only for the breach of essential contractual obligations, limited to the typical, foreseeable damage and at most to the price paid. Liability for lost profit, indirect damage or the absence of a particular public effect is excluded. Mandatory statutory liability remains unaffected.
16. No connection with the vehicle manufacturer
LUCERANTIS GROUP has no connection with Ferrari. The vehicle is the provider's campaign vehicle; Ferrari and SF90 Stradale are trademarks of their owners. Buying a place creates no relationship with the manufacturer.
17. Complaints, applicable law and disputes
Complaints can be submitted via the contact form; the provider confirms receipt and responds without delay, at the latest within 8 days. The law of the Republic of Serbia applies. Mandatory consumer protection rules of the country in which a consumer has their habitual residence remain unaffected. A consumer may initiate out-of-court resolution of a consumer dispute before a body on the list kept by the ministry responsible for trade, in accordance with the Law on Consumer Protection.
